Йдеться про те, що у лютому 2017 року рішенням Житомирської обласної ради безпідставно погоджено суб’єкту господарювання надання спеціального дозволу на користування надрами з метою видобування цирконієвих руд та супутніх корисних компонентів Південно-Західної ділянки Яструбецького родовища, що в Олевському районі.
Зокрема, зазначена земельна ділянка, на якій розташоване родовище, належить до заповідних лісових урочищ – охоронної зони Поліського природного заповідника загальнодержавного значення.
У цьому заповіднику, з метою захисту його природних комплексів від господарської діяльності на прилеглих до нього територіях, створена охоронна зона загальною площею майже 12,5 тис га, у якій не допускається будівництво промислових та інших об’єктів, мисливство, розвиток господарської діяльності, що може призвести до негативного впливу на території та об’єкти природно-заповідного фонду.
Крім того, погодження спеціального дозволу на користування надрами надано без зазначення його площі.
Відстоюючи інтереси держави та територіальної громади, прокуратура області подала до суду позов про визнання протиправним та скасування протиправного погодження надання спеціального дозволу на користування надрами, який наразі задоволено у повному обсязі.
