Прокурор Житомирської області Любомир Війтович у середу, 17 січня 2018 року, повідомив сільському голові однієї із сільських рад Олевського району та директору ПП «Будпослуги №1», який водночас є депутатом районної ради, про підозру у скоєнні кримінальних правопорушень.
Зокрема, голову сільської ради та його спільника директора-депутата підозрюють у вчиненні злочинів, передбачених ч.1 ст.366 (складання та видача службовою особою завідомо неправдивих офіційних документів) КК України. Також обох підозрюють у скоєнні злочинів, передбачених ст. 191, а саме, сільського голову — за ч. 4 (розтрата чужого майна шляхом зловживання службовою особою своїм службовим становищем, вчиненому за попередньою змовою групою осіб), директора-депутата – за ч.5 (розтрата чужого майна шляхом зловживання службовою особою своїм службовим становищем, вчиненому за попередньою змовою групою осіб у великих розмірах) КК України.
Установлено, що зазначені особи протягом 2015-2016 років шляхом складання та видачі офіційних документів, у яких містилися неправдиві відомості, незаконно заволоділи частиною грошових коштів, які призначались на виконання комплексу робіт з капітального ремонту низки об’єктів сільської громади.
Внаслідок таких дій, сільський голова вчинив розтрату бюджетних коштів однієї з сільських рад Олевського району на суму понад 300 тисяч гривень, а керівник підприємства, який водночас є депутатом райради, заволодів бюджетними коштами на суму понад 400 тисяч гривень.
Факт заволодіння бюджетними коштами шляхом зловживання службовим становищем було викрито завдяки спільним діям прокуратури області та Головного управління Нацполіції в області, яке наразі проводить досудове розслідування.
Процесуальне керівництво у кримінальному провадженні здійснює прокуратура Житомирської області.
Довідково: санкції зазначених статей передбачають покарання, зокрема, ч.4 -позбавлення волі на строк від 5 до 8 років з позбавленням права обіймати певні посади чи займатися певною діяльністю на строк до 3 років, ч. 5 — позбавлення волі на строк від 7 до 12 років з позбавленням права обіймати певні посади чи займатися певною діяльністю на строк до 3 років та з конфіскацією майна.
У державних реєстрах, керівником ПП БУДПОСЛУГИ №1 до 29.03.2016 був діючий мер міста Олевськ, Олег Васильович Омельчук. З цього випливає, що основним фігурантом справи він і є. Відповідно він і підписував документи. Дивно чому звинувачують директора, який був призначений після скоєння злочину.
