До Вищої ради правосуддя надійшло повідомлення судді Олевського районного суду Житомирської області Винара Любомира Вікторовича про втручання в його діяльність як судді з боку посадових осіб вказаного суду шляхом втручання в автоматизовану систему розподілу судових справ.
У повідомленні зазначено, що після відсторонення від виконання обов’язків судді Волощука В.В., судові справи, які ним розглядалися, 15 лютого 2016 року без рішення зборів суддів були передані для проведення повторного автоматизованого розподілу між суддями Ковальчуком М.В., Стратовичем О.В. та Винарем Л.В., які фактично працюють у суді.
Відповідно до звітів про автоматизований розподіл судових справ між суддями було встановлено, що судді Ковальчук М.В. та Стратович О.В. були виключені (заблоковані) з автоматизованого розподілу справ з формулюванням «зайнятий згідно табелю (інше)», тому справи розподілялися лише судді Винару Л.В., хоча в табелі обліку використання робочого часу зазначених суддів 15 лютого 2016 року зазначений як робочий час.
Наказом голови Олевського районного суду Житомирської області Ковальчука М.В. від 5 квітня 2016 року № 23 було зафіксовано виявлення факту допущення помилки у системі під час зазначеного повторного автоматизованого розподілу справ автоматичною системою документообігу суду.
Суддя Винар Л.В. повідомляє, що такі факти не були наслідком технічної помилки, а вказівка щодо заблокування суддів Ковальчука М.В. та Стратовича О.В. при здійсненні автоматизованого розподілу справ надана головою Олевського районного суду Житомирської області, про що він дізнався від керівника апарату суду.
У зв’язку із цим суддя Винар Л.В. вважає, що безпідставне втручання в автоматизовану систему документообігу суду з боку посадових осіб Олевського районного суду Житомирської області є втручанням в його діяльність як судді щодо здійснення правосуддя.
