Якби ліси Олевського АПК, перебували у власності комунального підприємства, яке належить Олевській громаді, тоді за рахунок його доходу можна було б суттєво збільшити бюджет, знизити ціну дров для садочків, шкіл та інших об’єктів соціальної сфери.
Влада Олевської ОТГ на 18 сесії міськради, яка відбулась 16 листопада влаштувала чергове шоу. Чим довели свою некомпетентність або особисту зацікавленість в тому щоб ліси АПК, протизаконно залишалися у власності Житомирського Обласного Комунального Агролісогосподарского Підприємства «ЖИТОМИРОБЛАГРОЛІС» Житомирської Обласної Ради.
«Житомироблагроліс» очолює депутат Житомирської облради від ВО «Батьківщина» Ігор Рибинський. Він є заступником голови постійної комісії з питань екології, охорони навколишнього середовища та використання природних ресурсів.
Може юристи, Олевської ОТГ мало вивчили питання і не в курсі, що розпорядження З.Р. Фіца про створення комунального підприємства «Олевськагроліс» від 01.09.2000 р., було скасовано розпорядженням першего заступника Олевской РДА В.А. Михайленко № 201 від 7.08.2002 р. А в подальшому, землі АПК були незаконно (без рішення депутатів районної Ради) передані в ДП «Олевський лісгосп АПК » Житомирського Обласного Комунального Агролісогосподарского Підприємства «ЖИТОМИРОБЛАГРОЛІС» Житомирської Обласної Ради.
Тому боротися з рішенням, яке вже скасовано виглядає як то неадекватно з боку керівництва і юристів Олевської ОТГ.
І якщо юристи міської ради не в курсі, то при поверненні лісів у власність громади доведеться створити комунальне підприємство і цьому підприємству передати землі лісового фонду про яке йде мова. Як зробив свого часу Зіновій Фіц коли був головою району.
Комунальним підприємством в Україні є самостійний господарюючий статутний суб’єкт, що може здійснювати виробничу, науково-дослідну та комерційну діяльність із метою одержання відповідного прибутку (доходу).
Органи місцевого самоврядування можуть утворювати, реорганізовувати та ліквідовувати комунальні підприємства (заклади, установи). Відносини цих органів з комунальними підприємствами будуються на засадах їх підпорядкованості, підзвітності та підконтрольності органам місцевого самоврядування. До відання виконкомів органів сільських, селищних і міських рад згідно з їх повноваженнями по управлінню комунальною власністю належить встановлення порядку та здійснення контролю за використанням прибутків комунальних підприємств, а також заслуховування звітів про роботу їхніх керівників.
