Законодавство України про охорону дитинства передбачає, що держава гарантує дитині право на охорону здоров’я, безоплатну кваліфіковану медичну допомогу в державних і комунальних закладах охорони здоров’я, сприяє створенню безпечних умов для життя і здорового розвитку дитини, раціонального харчування, формуванню навичок здорового способу життя.
Коростенською місцевою прокуратурою з метою встановлення підстав для представництва інтересів держави в суді вивчено стан дотримання законодавства України щодо благоустрою населених пунктів.
Установлено, що на балансі Олевської міської ради перебувають дитячі майданчики, розташовані в м. Олевськ, які у порушення вимог чинного законодавства, не відповідають вимогам безпеки.
Зокрема, міською радою не забезпечено проведення робіт з обстеження і перевірки технічного стану конструкцій дитячих майданчиків, їх технічної інвентаризації та паспортизації, що могло завдати тяжких наслідків здоров’ю дітей. Це, у свою чергу, порушує визначені чинним законодавством інтереси держави у сфері охорони дитинства.
З метою усунення виявлених порушень, Коростенська місцева прокуратура подала до суду адміністративний позов про визнання незаконною бездіяльність Олевської міської ради та зобов’язання вчинити відповідні дії.
Лише після того, як судом прийнято позов до розгляду, Олевська міська рада провела необхідне обстеження конструкцій на дитячих майданчиках, які перебувають на її балансі, визначила їх технічний стан та вчинила усі необхідні дії.
Відтак, Коростенська місцева прокуратура відстояла у суді права дітей на безпечне дозвілля.
