Житомирська прокуратура довела у суді незаконність надання Держгеонадрами ТОВ «Амбер Холдинг» дозволу на вивчення та розробку ділянок надр бурштину площею понад 10 тис. га.
«За позовом прокуратури Житомирської області судом визнано протиправним та скасовано спеціальний дозвіл на користування надрами, виданий Державною службою геології та надр України товариству з обмеженою відповідальністю «Амбер Холдинг» для геологічного вивчення, у тому числі дослідно-промислової розробки родовища бурштину площею понад 10 тис га. Йдеться про те, що у 2016 році Держгеонадрами протиправно видано ТОВ «Амбер Холдинг» спеціальний дозвіл для геологічного вивчення та дослідно-промислової розробки родовища бурштину — Козюлівської ділянки, що в Овруцькому районі», – йде мова у повідомленні.
Спецдозвіл видали з порушенням вимог Цивільного кодексу України, Закону України «Про оренду державного та комунального майна» та Порядку надання спеціальних дозволів на користування надрами. Також, у Держгеонадрах не врахували відмову Житомирської обласної ради щодо не погодження товариству видачі даного дозволу. Встановили й інші порушення чинного законодавства з метою уникнення процедури аукціону.
«Прокуратура області в інтересах держави та Житомирської обласної ради заявила позов про скасування зазначеного дозволу, який Житомирським окружним адміністративним судом задоволено у повному обсязі. Нагадаємо, що усього прокуратурою області, в інтересах держави та Житомирської обласної ради, цьогоріч заявлено 6 аналогічних позовів про скасування незаконних дозволів на здійснення геологічного вивчення, у тому числі дослідно-промислової розробки ділянок надр бурштину площею понад 18 тис га, що розташовані в Овруцькому та Олевському районах», – зазначають у відомстві.
