Відповідно до п. 3 Прикінцевих положень Закону України «Про добровільне об’єднання
територіальних громад» у селах, селищах, в яких знаходилися органи місцевого
самоврядування територіальних громад, що об’єдналися, обов’язки старости до обрання на
перших виборах старости виконує особа, яка здійснювала повноваження сільського,
селищного голови відповідної територіальної громади до об’єднання.
Інші норми Закону, які б врегульовували статус осіб, які виконують обов’язки старост до
обрання на перших виборах старости, відсутні.
Беручи до уваги, що виконання обов’язків старости покладаються, як правило, на
сільських, селищних голів (в окремих випадках, передбачених Законом України «Про місцеве
самоврядування в Україні» – на секретарів рад), цим особам вже присвоєні відповідні ранги
посадових осіб місцевого самоврядування, вони мають певну вислугу років.
Відповідно до ст. 15 Закону України «Про службу в органах місцевого самоврядування»
посадова особа місцевого самоврядування може бути позбавлена присвоєного відповідно до
цього Закону рангу лише за вироком суду. Якщо посадова особа місцевого самоврядування
обрана чи призначена на посаду нижчої категорії або залишила службу в ОМС, за нею
зберігається присвоєний ранг. У трудовій книжці посадової особи місцевого самоврядування
робиться запис про присвоєння, зміну чи позбавлення її відповідного рангу.
Пунктом 2 постанови КМУ від 09.12.2015 р. № 1044 «Деякі питання оплати праці
посадових осіб місцевого самоврядування об’єднаних територіальних громад»
рекомендовано ОМС зберегти за особами, які здійснювали повноваження сільського,
селищного, міського голови відповідної територіальної громади до об’єднання і виконують
обов’язки старости до обрання на перших виборах старост, посадовий оклад, надбавки та
доплати, які були їм встановлені на час переведення на посаду старости.
Отже, за особами, які виконують обов’язки старост, зберігаються посадові оклади,
надбавки та доплати, встановлені їм на посаді сільського, селищного голови (в окремих
випадках – на посаді секретаря ради).
