У понеділок, 29 січня 2018 року, прокурор Житомирської області Любомир Війтович, відповідно до вимог глави 37 КПК України, вручив депутату сільської ради, що в Олевському районі, підозру у скоєнні злочину за ч. 3 ст. 28, ч. 2 ст. 240 (незаконне видобування корисних копалин загальнодержавного значення, вчинене організованою групою) КК України.
Також повідомлено про підозру у незаконному видобуванні корисних копалин загальнодержавного значення у складі організованої злочинної групи ще чотирьом особам, які діяли спільно із депутатом сільської ради.
Установлено, що житель Олевського району, з метою незаконного збагачення, влітку 2017 року створив і очолив організовану групу, до складу якої увійшли місцеві жителі (серед них і депутат сільської ради) для спільного незаконного видобування корисних копалин загальнодержавного значення – бурштину.
Таким чином злочинна група, діючи з вересня по листопад 2017 року, порушуючи вимоги Кодексу України про надра, Закону України «Про охорону навколишнього природного середовища», не маючи відповідних дозволів, незаконно видобувала бурштин на території Поясківського та Тепеницького лісництв ДП «Білокоровицьке лісове господарство».
Злочинну діяльність викрито та припинено працівниками Управління захисту економіки в області Нацполіції, а незаконно видобутий бурштин, знаряддя і засоби вчинення злочину вилучено.
Під час досудового розслідування організатор і три співучасники групи визнали вину у повному обсязі, сприяли розкриттю злочину, у зв’язку з чим між ними та прокурором укладено угоди про визнання винуватості. Наразі у кримінальному провадженні за ч.3 ст. 28, ч. 2 ст. 240 КК України затверджено обвинувальний акт та скеровано до суду для розгляду по суті.
Досудове розслідування стосовно п’ятого члена групи, підозрюваного за ч. 5 ст. 27, ч.3 ст. 28, ч. 2 ст. 240 КК України, виділено в окреме кримінальне провадження та перебуває на стадії закінчення.
Розслідування проводило слідче управління Головного управління Нацполіції в області.
Державне обвинувачення у суді забезпечуватиме прокуратура області.
